Federal High Court Dismisses APP Suit Challenging Oyebamiji’s Eligibility, Awards N200,000 Costs
The Federal High Court sitting in Osogbo has dismissed a suit filed by the Action Peoples Party (APP) challenging the eligibility of the All Progressives Congress (APC) governorship candidate in Osun State, Asiwaju Munirudeen Bola Oyebamiji, to contest the August 15, 2026 governorship election.
In a judgment delivered on Wednesday in Suit No. FHC/OS/CS/50/2026, Action Peoples Party v. Bola Oyebamiji & 2 Ors., Justice Funmilayo Dame-Ajayi held that the suit disclosed no reasonable cause of action and upheld the preliminary objections raised by the respondents.
The court also held that the plaintiff failed to establish that it participated in the primary elections conducted by the respondents and, therefore, lacked the legal standing (locus standi) to institute the action.
Justice Dame-Ajayi consequently dismissed the suit for lacking merit and awarded costs of N200,000 against the plaintiff.
The APP had approached the court seeking the disqualification of Oyebamiji from participating in the forthcoming governorship election in Osun State.
During the proceedings, counsel to the respondents argued that the suit was incompetent and that the plaintiff lacked the legal capacity to challenge the APC candidate’s nomination. The court agreed with the respondents’ arguments and dismissed the case.
The judgment represents the latest judicial development relating to pre-election litigation ahead of the August 15 governorship poll in Osun State.
Meanwhile, the APC welcomed the ruling, describing it as a validation of its candidate’s nomination and eligibility to participate in the election.
