The Supreme Court of Nigeria has reportedly fixed November 16, 2026, for the hearing of an application to withdraw and dismiss an appeal filed by Mr Adekunle Rufai Omoaje in the protracted leadership dispute within the Action Alliance (AA).

The development follows the filing of a Notice of Withdrawal dated September 28, 2026, by Omoaje, seeking to withdraw his appeal, identified as SC/CV/162/2024, challenging the leadership of the party.

According to a statement issued by the Action Alliance Media Directorate on behalf of the party’s National Chairman, Chief Barr. Kenneth Udeze, the scheduled proceedings could bring the protracted legal dispute over the party’s leadership closer to resolution.

The statement said the appeal arose from an earlier judgment of the Court of Appeal in Abuja in Appeal No. CA/ABJ/CV/922/2022, which, according to the party, affirmed the validity of the National Executive Committee led by Udeze.

Omoaje had approached the Supreme Court after the Court of Appeal’s decision. His reported move to withdraw the appeal is now expected to be considered by the apex court on the scheduled date.

The party’s statement maintained that the dismissal of the appeal would leave the Court of Appeal’s judgment standing and strengthen its position that Udeze remains the party’s lawful National Chairman.

However, the formal legal effect of the withdrawal will depend on the Supreme Court’s proceedings and the terms of any order made by the court.

AA Calls for Compliance with Court Judgment

The Action Alliance Media Directorate also called on the Independent National Electoral Commission (INEC) to recognise and comply with the relevant court judgments concerning the party’s leadership.

The party alleged that INEC had failed to give its leadership full recognition despite the Court of Appeal’s decision. It urged the electoral commission to take the necessary steps in line with the applicable court orders.

The allegations against INEC were contained in the party’s statement. The commission’s position on the latest development was not included in the statement.

Party Urges Members to Remain Calm

Reacting to the development, supporters of the Udeze-led faction described the reported withdrawal of the appeal as an important development for the party, expressing hope that it would help resolve the prolonged leadership dispute.

The party said it was preparing to focus on its organisational activities and preparations for the 2027 general elections.

It also appealed to members and supporters across the country to remain calm, law-abiding and guided by official communications while the legal process runs its course.

The Supreme Court’s proceedings on November 16 are expected to clarify the next legal steps in the matter, although the final outcome will depend on the orders made by the court.

The statement was signed by the Action Alliance Media Directorate on behalf of Chief Barr. Kenneth Udeze, National Chairman of the party.
