Tribunal Sacks Ondo Federal Lawmaker
By Niyi Olutunde, Akure
The Ondo state Election petition tribunal sitting in Akure has sacked member representing Okitipupa/Irele federal constituency, Hon Ikengboju Gboluga of the PDP.
The court however declared the APC Candidate Albert Akintoye (aka S.O.T) the winner of the election.
The federal lawmaker was removed over ineligibility to contest the February 23, 2019 House of Representatives election.
The tribunal noted that the petitioner had proved that the respondent sworn to an oath of allegiance to the United Kingdom and hence ineligible to contest for political office in Nigeria as enshrined in the section 66 of 1999 constitution.
The three man panel headed by justice Nuhu Adi directed the Independent National Electoral Commission, (INEC) to withdraw his certificate of return and issue another one to the petitioner, Mr Albert Akintoye of the All Progressives Congress, APC.
Counsel to the petitioner, Mr Adamson Adeboro described the judgement as good for the nation’s democracy and a prove that the judiciary is functional.
Speaking with journalists after the judgement, the petitioner, Mr Albert Akintoye expressed pleasure over the judgement noting that his mandate has been restored.
However, one of the Counsel to the respondent, Mr Olumide Ogunje said the judgement would be studied and necessary action would be taken.
Reacting to the judgement, the Ondo State APC Chairman, Mr Ade Adetimehin applauded the judgement describing it as a plus to the party at the National Assembly and boost to their chances in subsequent elections.
