Court Jails Man For Stealing Pumping Machine In Osun

A magistrates court sitting in Osogbo, capital of Osun State have sentenced a 30-year-old man, Hammed Azeez to 1-year imprisonment for stealing pumping machine from an hotel.

Azeez was convicted on Monday by Magistrate Daramola on three count charges.

CityMirrorNews gathered that Azeez was arraigned alongside Adekunle Joshua, aged 36 on April 10, 2022 before Magistrate Daramola on a three-count charge bordering on Conspiracy, Felony and stealing.

The Police Prosecutor, Assistant Superintendent of Police, Fagboyingbo Abiodun had told the court that the convicts committed the offence on April, 6 at about 3:04am at Ideal nest hotel Osogbo.

He explained that the convict stole four Pumping Machines worth Seven hundred and five thousand (N705,000.00) property of Ideal nest hotel and sold the item to one Adekunle Joshua.

He stressed that Joshua bought the items from Azeez knowing fully that it was stolen.

According to him the offence contravenes Section 516, 390(9) and 427 of the Criminal Code Cap 34 Volume 2 Laws of Osun State of Nigeria 2022.

The duo pleaded not guilty to the allegations on the first day of arraignment and were granted bail in the sum of N200,000 with two sureties each while the case was adjourned for mention.

Upon several adjournments and hearing, the Magistrate while delivering judgment on Tuesday discharged Adekunle Joshua on count 1 and found Azeez guilty on count 2.

The Magistrate there after asked the convicts if they understand the court ruling and what they can say to it. The convicts said admitted and pleaded for mercy.

Magistrates Daramola sentenced Azeez to 1year imprisonment with an option of fine of N200,000 naira .

The Charge sheet reads ” That you Hammed Azeez 30, M, Adekunle Joshua 36 on the 6th day of April 2022 at about 3:04am at ideal nest hotel Osogbo in the magisterial district did conspire together to commit felony to wit stealing and thereby committed an offence contrary to and punishable under section 516 of the criminal code cap 34 volume 11 laws of Osun State of Nigeria 2002.

Count 2: That you Hammed Azeez M, on the same day, time and place in the aforementioned magisterial district did steal four pumping machine valued 705,000 property of idea nest hotel and thereby committed an offence contrary to and punishable under section 390(9) of the criminal code cap 34 volume 11 laws of Osun State of Nigeria 2022.

Count 3: That you Adekunle Joshua on the same day at about 9am did received Four pumping machine from one Hammed Azeez knowing fully they are stolen items and there committed an of fence contrary to and punishable under sections 417of the criminal code 34 volume 11 laws of Osun State Nigeria 2002.”
