Osun PDP Guber Primary: Babayemi’s Counsel Reacts To Court Judgement, Says It’s An Abuse Of Court Process
Barrister Edmund Biriomoni, Counsel to Omooba Dotun Babayemi, the gubernatorial candidate of the Peoples Democratic Party (PDP), has asserted that the judgement of a Federal High Court sitting in Abuja which seeks to invalidate the governorship primary that produced the Gbongan-born Prince as one that cannot achieve what it seeks to, describing it is an abuse of court process.
Biriomoni maintained that the judgement was obtained by fraud as material facts were not placed before the Court,noting that the said judgement did not set aside the primaries conducted at WOCDIF neither did it set-aside and/ or nullify the candidature of Omooba Dotun Babayemi as the candidate of the PDP for Osun State Gubernatorial Election scheduled for July 16, 2022.
The Counsel who made the clarifications while speaking with newsmen in Osogbo, said the Judge was not aware that there were valid court orders that affected and determined the party primaries in state.
“The matters for determination here are : “Does the party have the power to nominate candidates and the NEC of PDP have the right to approve guidelines for the conduct of primaries? The answer is an absolute yes where such primaries were conducted within the laid down electoral law and subsisting valid court orders/ judgment which are binding on parties”
Continuing, Biriomoni added that “The questions for determination here are elementary and pedestrian. The reliefs sought are more embarrassing as same are futile academic exercises without achieving their desired goals. The suit was filed on the 14th of March, 2022 shortly after the High Court on the 10th of March, 2022 nullified the primaries conducted at stadium and affirmed the primaries conducted at WOCDIF. This judgement did not address nor set aside our primaries”
According to him, the judgement did not affect the case currently being pursued at the Federal High Court sitting in Osogbo, adding that the judiciary would determine the rightful gubernatorial candidate of the PDP after reviewing the complete facts of the cases at hand.
“This judgement does not affect our case presently at the Federal High Court Osogbo and would be overturned on appeal.We’re continuing with our case without any form of distraction whatsoever.Matters for determination are completely different; we shall do whatever it is worth to appeal the said judgment in order to set it aside at the Court of Appeal, Abuja on ground of obtaining the said judgment by fraud.They deliberately failed to disclose material facts before the court which includes the subsisting court orders and judgment which validated the party primaries at WOCDIF that produced Omooba Dotun Babayemi as the Candidate of the party for the Osun State Gubernatorial election scheduled to hold on the 16th of July,2022.” he said.
Biriomoni assured that nothing would distract Babayemi and the people of the state who are expectant of a new dawn in Osun from reaching the desired point of success as this recent action clearly shows the desperation which definitely has ended in futility.The period of impunity by political parties is over and the era of the rule of law has come to stay with grave consequences if disregarded or disobeyed.
